1. Acceptance of Terms

By accessing and using the Moanr application ("App"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and MedEnc Technologies ("Company," "we," "us," or "our").

2. App Description and Purpose

Moanr is a mobile, web, and desktop application designed to help couples connect and improve their relationships. The App provides tools for partners to track connection, share insights, and engage with relationship-focused content and features.

Not a Medical App: Moanr is not a medical device or medical application. It does not provide medical advice, diagnosis, or treatment. All content, tools, and features in the App are for informational and relationship-support purposes only and are not a substitute for professional medical, mental-health, or therapeutic care. Always consult a qualified professional for questions about your health or well-being.

3. User Accounts and Security

  • Account Creation: You must create an account to use the App. You are responsible for providing accurate and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must not share your login information with any third party. You agree to notify us immediately of any unauthorized access to or use of your account.
  • Data Encryption: User data stored within the App is encrypted using AES-256 to protect your privacy. We cannot access your unencrypted data.
  • Data Storage: Data is stored securely and encrypted in MedEnc's secure cloud.

4. Sharing of Information

  • User Control: You have complete control over who you share your information with within the App.
  • Consent: Sharing your information with a partner or other User requires explicit consent from you.
  • No Liability: We are not responsible for how other Users utilize the shared information. We recommend exercising caution when sharing sensitive information.
  • Data Retention: Once shared, the data may be retained by the other user, according to their own data retention policy.

5. User Conduct

You agree not to:

  • Upload or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.
  • Impersonate any person or entity.
  • Attempt to gain unauthorized access to the App or its systems.
  • Use the App for any illegal or unauthorized purpose.
  • Distribute viruses or other harmful code.
  • Interfere with or disrupt the App's functionality.
  • Use the App to provide medical advice.
  • Use the App to facilitate or enable illegal activity.

6. Disclaimer of Medical Advice

  • Not a Medical App: Moanr is not a medical application, medical device, or healthcare service. Content and features in the App are for informational purposes only.
  • No Medical Professional: Moanr is not a substitute for professional medical advice, diagnosis, treatment, counseling, or therapy.
  • Consult a Qualified Professional: Always consult with a qualified healthcare provider or other licensed professional for any questions you may have regarding your health, mental health, or well-being.
  • No Responsibility: We are not responsible for any actions taken based on information obtained through the App.

7. Limitation of Liability

  • As-Is Basis: The App is provided on an "as-is" and "as-available" basis.
  • No Warranty: We make no warranties or representations about the accuracy, reliability, or completeness of the App's content.
  • Indirect Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
  • Maximum Liability: Our maximum liability to you for any claim arising out of or relating to these Terms or your use of the App shall be limited to $100,000 US.

8. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or relating to your use of the App or your violation of these Terms.

9. Intellectual Property

  • Ownership: The App and its content, including but not limited to text, graphics, logos, and software, are owned by the Company or its licensors and are protected by intellectual property laws.
  • Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.

10. Termination

We may terminate your access to the App at any time, with or without cause, and without notice.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after the changes constitute your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration.
